WiFi network terms of use

ARTICLE 1 – PURPOSE

The purpose of this document is to define the conditions of use of the Internet service of Atelier Fleuriste SARL. This service allows the user with a laptop or PDA equipped with a virtual W-LAN network session (IEEE 802.11b, g and n) to connect to wireless and broadband Internet from areas covered by the Internet. The Internet service of Atelier Fleuriste SARL includes the basic functions of Internet access: provision of IP address (access to DNS, gateway to the Internet allowing browsing on the Internet, access to a messaging ...). The service of Atelier Fleuriste SARL does not include the supply of mailboxes, nor the hosting of WEB pages. Internet service can be accessed from any terminal equipped with a W-LAN (IEEE802.11b) network adapter as long as it meets Wi-Fi specifications and the network adapter is IEEE 802.11b certified. The Internet service of Atelier Fleuriste SARL allows the user to connect to the Internet, communicate by an e-mail system and download files without limitation in terms of the volume of data exchanged. However, FTP and Peer to Peer are not supported.

ARTICLE 2 - ACCESS TO THE INTERNET SERVICE OF ATELIER FLEURISTE SARL

Access to the Internet service is available during the opening hours of Atelier Fleuriste SARL. The use of the service is free for Verttige and Greenlab customers. There is no user support service.

ARTICLE 3 - COMMITMENT OF THE USER OF THE SERVICE

3.1. With regard to the use of the Internet, the Internet user is informed that the Internet is a network carrying data that may be protected by intellectual property rights or violate the legal provisions in force. The Internet user is therefore prohibited from transmitting on the Internet any data that is prohibited, illicit, illegal, contrary to morality or public order and infringing or likely to infringe the rights of third parties and in particular intellectual property rights.

3.2. It is expressly recalled that the Internet is not a secure network. Under these conditions, it is up to the Internet user to take all appropriate measures to protect his own data and / or software, in particular from contamination by any viruses circulating on the Internet network or intrusion by a third party into the system of his terminal (laptop, personal or mobile assistant) for any purpose whatsoever,  and to make backups on his laptop and personal assistant before and after the implementation of the services.

3.3. The Internet user also acknowledges being fully informed of the unreliability of the Internet network, especially in terms of lack of security relating to data transmission and non-guarantee of performance relating to the volume and speed of data transmission. The Internet user acknowledges being informed that the integrity, authentication and confidentiality of information, files and data of any kind that he wishes to exchange on the Internet network cannot be guaranteed on this network. The Internet user must therefore not transmit via the Internet messages whose confidentiality he would like to see guaranteed in an infallible manner.

3.4. The Internet user shall refrain from any fraudulent, abusive or excessive use of the services, such as in particular the voluntary or involuntary congestion of mail servers and/or email recipients by wild direct mail (spamming, bulk e-mail, junk e-mail or mail bombing) or its network, or the sending of attractive messages necessarily generating a large number of responses (teasing or trolling) that may thus disrupt the availability of said servers or  network.

3.5. With regard to products or services on the Internet, the Internet user addresses directly to the content providers any complaint relating to the performance of the services rendered by them or the sale of the products by them.

3.6. The Internet service also warns the user about the nature and diversity of the content available on the Internet, which may be likely to harm minors.

ARTICLE 4 - COMMITMENTS AND RESPONSIBILITY OF ATELIER FLEURISTE SARL

4.1. Le Atelier Fleuriste SARL implements all the means at its disposal to ensure access to the service even if it cannot guarantee the speed, which depends in particular on the number of users connected simultaneously.

4.2. Le Atelier Fleuriste SARL is not responsible for the content accessible via the Internet and any damage that may arise from their use. Le Atelier Fleuriste SARL nevertheless informs users of the service that the new provisions applicable to the fight against terrorism imply for the access provider that it must record and keep for a maximum period of 12 months the operational data of the connections made by the users: sender, recipient, date and time of the start of the connection,  date and time of the end of the connection, addresses visited except for their content. An exception may be made to this rule of confidentiality to the extent permitted by law, at the request of public and/or judicial authorities.

4.3. Le Atelier Fleuriste SARL cannot be held responsible for the use of data and information that the user of the service would have entered on the Internet. Le Atelier Fleuriste SARL declines all responsibility for the consequences of fraudulent, abusive or excessive use of the service, such as in particular the voluntary or involuntary congestion of mail servers or email recipients by wild direct mail (spamming, bulk e-mail, junk e-mail or mail bombing) or its network, or the sending of attractive messages necessarily generating an imposing number of responses (teasing or trolling) that can thus disrupt the  availability of such servers or network.

4.4. The responsibility of Atelier Fleuriste SARL can not be engaged vis-à-vis the user of the service:

  • In case of misuse of the service,

  • In case of improper installation and/or misconfiguration and/or malfunction of the laptop, PDA and/or W-LAN (IEEE 802.11b) network adapter,

  • In the event of non-compliance with its obligations,

  • If it is impossible to access a company's virtual private network via the Internet,

  • In case of disruptions or interruptions,

  • In the event of disruptions and/or total or partial unavailability, and/or interruption of all or part of the services offered on networks operated by Third Party Operators,

In case of force majeure within the meaning of the jurisprudence of the Court of Cassation.

ARTICLE 5 - RESPONSIBILITY OF THE USER

The user of the Internet service is solely responsible for any direct or indirect, material or immaterial damage caused to third parties as a result of its use.

ARTICLE 6 - SUSPENSION OR TERMINATION

Le Atelier Fleuriste SARL, at the request of third parties and/or any competent authority, reserves the right to suspend the Wi-Fi service temporarily or permanently without its responsibility being sought and without the user being able to claim any compensation or repair.

ARTICLE 7 - COMMITMENT OF THE USER

Registration for the Internet service of Atelier Fleuriste SARL in order to obtain an access code constitutes acceptance of these rules of use.
